1. כללי

משרד עורכי דין ונוטריון יריב קדם ("המשרד") שומר על פרטיות לקוחותיו, הפונים אליו, והמשתמשים באתר זה ("האתר"), בכפוף להוראות כל דין ומדיניות פרטיות זו.

מדיניות פרטיות זו מפרטת את האופן שבו נאסף, נשמר ומעובד מידע אישי אודותיך באתר ובכלל, בהתאם לחוק הגנת הפרטיות, התשמ"א-1981 ותיקוניו, לרבות תיקון 13.

הפנייה אליך היא ללא הבדלי מגדר; השימוש בלשון זכר או נקבה הוא לצרכי נוחות בלבד.

2. בעל השליטה במידע

עו"ד ונוטריון יריב קדם הינו בעל השליטה במידע האישי הנאסף באמצעות האתר ובמסגרת מתן השירותים המשפטיים והנוטריוניים. פרטי ההתקשרות מופיעים בעמוד "צור קשר" באתר.

3. סוגי המידע הנאסף

3.1 מידע הנמסר ביוזמתך

מידע הנמסך על ידך למשרד ביוזמתך, באמצעות טפסי האתר, אימיילים, ווטסאפ, או בכל דרך אחרת, המאפשר לזהות אותך באופן אישי, ובכלל זה:

• פרטים אישיים כגון שם/שמות, מספר תעודת זהות, כתובת, מספרי טלפון, כתובת דואר אלקטרוני
• מידע רלוונטי נוסף לטיפול המשפטי/נוטריוני כגון מסמכים, התכתבויות, פרטי פגישות ותכתובות
• פרטי תשלום וחיוב: פרטי כרטיסי אשראי, חשבונות בנק

3.2 מידע אוטומטי באתר

מידע הנאסף באופן אוטומטי באתר – נתוני כניסה לאתר, צפייה בדפי האתר, נתונים סטטיסטיים, העדפות גלישה ומיקום גיאוגרפי כללי.

4. מטרות איסוף ועיבוד המידע

המידע נאסף ומעובד למטרות הבאות:

• תפעול האתר, אבטחתו ושיווקו.
• מתן מענה, ייעוץ, טיפול וליווי משפטי, נוטריוני, ומקצועי, הנובעים מפנייתך למשרד באמצעים כלשהם ו/או כמוסכם בינך למשרד ו/או בכפוף לכל דין ו/או הוראות מדיניות פרטיות זו.
• תקשורת עמך ומשלוח מסרים מטעם המשרד.
• דיוור ישיר רק לפונים אל המשרד ולקוחותיו.
• עיבוד מידע הנובע מפנייתך אל המשרד, והשימוש בו.
• חיובים, תשלומים והנהלת חשבונות.
• שמירת מידע ומסמכים לשירות עתידי עבורך.
• הגנה על זכויות ואינטרסים חיוניים שלך.
• תיעוד להליכים משפטיים.
• הגנה סבירה על אינטרסים לגיטימיים של המשרד.
• עמידה בהוראות חוק, רגולציה, אתיקה והוראות כל דין החלות על המשרד.

5. אחסון המידע ואבטחתו

המידע שמור במאגרי מידע מאובטחים כדין, לרבות:

• מערכות דואר אלקטרוני ואחסון ענן של Microsoft (ארה"ב).
• מערכות ניהול לקוחות של פיקסדיגיטל בע"מ, פיירברי בע"מ.
• חברות סליקה והנהלת חשבונות מורשות כדין בישראל – Grow, קארדקום.
• האתר בנוי על פלטפורמת WordPress ומאוחסן בשרתים מאובטחים באמצעות חברת Web3D.

המשרד מיישם מערכות ונהלים עדכניים לאבטחת מידע. יחד עם זאת, אין ביטחון מוחלט מפני חדירה בלתי מורשית, והמשרד אינו מתחייב לחסינות מוחלטת.

הסכמתך למדיניות זו מהווה גם הסכמה לשמירת המידע ולהעברתו לגורמים הנ"ל, בכפוף למנגנוני העברת מידע כדין.

6. תקופת שמירת המידע

המידע יישמר למשך התקופה הנדרשת למטרות השירותים בתוספת תקופת התיישנות. מידע שאינו נדרש עוד יימחק בהתאם לשיקול דעת המשרד ובכפוף להוראות כל דין.

7. העברת מידע לצדדים שלישיים

המשרד לא יעביר את פרטיך האישיים לצדדים שלישיים, למעט במקרים הבאים:

• לצורך אחסון המידע ואבטחתו כאמור.
• לצורך מתן השירותים המשפטיים/נוטריוניים כגון בתי משפט, רשויות, רואי חשבון, מתרגמים בישראל ובחו"ל, שליחים ומומחים נדרשים.
• לספקי שירותים למשרד כמו מומחי מחשוב ואבטחת מידע, קידום אתרים, מתרגמים בישראל ובחו"ל, שליחים, נותני שירותים טכניים ומשרדיים אחרים.
• לספקי שירותים טכנולוגיים באתר: Google ו-YouTube (באמצעות עוגיות והטמעות באתר כמפורט להלן) – לצורך תפעול, אנליטיקה והצגת תכנים.
• שימוש בכלי בינה מלאכותית באופן אנונימי או בלתי מזוהה.
• למקרה של מחלוקת, טענה, תביעה או הליכים משפטיים בינך לבין המשרד.
• למקרה בו תבצע פעולות בניגוד לדין באתר או באמצעותו.
• בהתאם לצו בית משפט או הוראת רשות מוסמכת.
• אם הדבר נדרש באופן סביר להגנה על זכויות המשרד או למניעת נזק.

הסכמתך למדיניות זו מהווה גם הסכמה להעברת מידע לגורמים הנ"ל.

8. שימוש בקובצי עוגיות (Cookies)

האתר עושה שימוש בקובצי "עוגיות" – קבצים קטנים הנשמרים במכשירך בעת הגלישה. העוגיות משמשות למטרות שונות:

• עוגיות הכרחיות – תפעול תקין של האתר, ובדיקות טכניות (כגון עוגיות אבטחה, מספרי טלפונים חכמים באתר).
• עוגיות פונקציונליות – שמירת העדפות שפה, הגדרות אישיות ובחירות פרטיות (כגון שמירת בחירתך בבאנר ההסכמה).

עוגיות נוצרות על ידי צדדים שלישיים (כמו Google, YouTube, WordPress, CRM Fix Digital, CRM Fireberry) הינם בכפוף למדיניות הפרטיות שלהם.

באפשרותך לנהל את העדפות העוגיות באמצעות הגדרות הדפדפן שלך. הסרת עוגיות מסוימות עלולה לפגוע בתפקוד האתר.

9. שימוש בכלי בינה מלאכותית (AI)

המשרד עושה שימוש בכלי בינה מלאכותית כאמצעי עזר במסגרת מתן שירותיו, בהתאמה מלאה להוראות חוק הגנת הפרטיות, התשמ"א-1981 ותיקוניו, לרבות תיקון 13.

לצורך זה, תרגומים ועיבוד מסמכים הכוללים מידע אישי ומידע אישי רגיש נעשים באמצעות חשבון מסחרי מסוג Claude for Work (Team) של חברת Anthropic PBC, במסגרתו המשרד הוא בעל השליטה במידע (Controller), ואנתרופיק משמשת כמעבדת מידע בלבד (Processor), אינה משתמשת במידע לאימון מודלים או לצרכים אחרים מאשר לטובת המשרד, והמידע מוגן בכפוף לנספח עיבוד נתונים (DPA) מפורט. המשרד עשוי לעשות שימוש בכלי בינה מלאכותית אחרים ללא הזנת פרטים מזהים או אישיים, או במצב אנונימי בלבד.

השימוש בכלי בינה מלאכותית אינו מחליף את שיקול הדעת המקצועי של המשרד.

10. מסרים קבוצתיים מהמשרד / דיוור ישיר

המשרד עשוי לשלוח ללקוחותיו מידע שיווקי או פרסומי בדואר אלקטרוני, רק אם נתת הסכמה מפורשת לכך או אם החוק מאשר זאת. בכל מקרה, תוכל/י לבטל את הסכמתך באמצעות הוראה במייל חוזר או דרך קישור הביטול שבגוף ההודעה.

11. זכויותיך

עומדות לך הזכויות הבאות, בכפוף להוראות חוק הגנת הפרטיות, והוראות הדין לגבי עורכי דין ונוטריונים:

• זכות עיון: לעיין במידע כפי שהוא שמור עליך במאגרי המשרד- תרגום לשפה אחרת יהיה כרוך בתשלום.
• זכות תיקון: לבקש תיקון מידע שגוי או לא מדויק.

12. קישורים לאתרים חיצוניים

בהפנייה של האתר באמצעות קישורים לאתרים אחרים, מדיניות פרטיות זו אינה חלה, אלא של האתר המופנה בלבד.

13. שינויים במדיניות הפרטיות

המשרד שומר לעצמו את הזכות לעדכן מדיניות זו מעת לעת. מועד העדכון האחרון מצוין בראש המסמך. מומלץ לעיין במדיניות פרטיות זו בכל כניסה אל האתר או הפנייה אליה.

The law office of Yariv Kedem, Advocate and Notary ("the Office") maintains the privacy of its clients, those who contact it, and users of this website ("the Website"), subject to the provisions of all applicable law and this Privacy Policy.

This Privacy Policy details the manner in which personal information about you is collected, stored and processed on the Website and in general, in accordance with the Privacy Protection Law, 5741-1981 and its amendments.

Advocate and Notary Yariv Kedem is the data controller of the personal information collected through the Website and in the framework of providing legal and notarial services. Contact details appear on the "Contact Us" page of the Website.

Data provided by you to the Office at your initiative, through the Website forms, emails, WhatsApp, or by any other means, which enables your personal identification, including:

The Data is collected and processed for the following purposes:

• Email systems and cloud storage of Microsoft (USA).
• Customer management systems of Fix Digital Ltd., Fireberry Ltd.
• Legally authorized clearing and accounting companies in Israel – Grow, Cardcom.
• The Website is built on the WordPress platform and hosted on secured servers through Web3D company.

The Office implements up-to-date systems and procedures for data security. However, there is no absolute security against unauthorized intrusion, and the Office does not guarantee absolute immunity.

Your consent to this policy also constitutes consent to the storage of data and its transfer to the aforementioned entities, subject to lawful data transfer mechanisms.

6. Data Retention Period

The data shall be retained for the period required for the purposes of the services plus the statute of limitations period. Data that is no longer required shall be deleted according to the Office's discretion and subject to the provisions of all applicable law.

7. Transfer of Data  to Third Parties

The Office shall not transfer your personal details to third parties, except in the following cases:

• For the purpose of storing and securing the data as stated.
• For the purpose of providing legal/notarial services such as courts, authorities, accountants, translators in Israel and abroad, couriers and required experts.
• To service providers to the Office such as computing and data security experts, website promotion, translators in Israel and abroad, couriers, other technical and office service providers.
• To technological service providers on the Website: Google and YouTube (through cookies and embeds on the Website as detailed below) – for operation, analytics and content display.
• Use of artificial intelligence tools anonymously or in an unidentified manner.
• In case of dispute, claim, lawsuit or legal proceedings between you and the Office.
• In case you perform actions contrary to law on the Website or through it.
• Pursuant to a court order or instruction of a competent authority.
• If reasonably required to protect the rights of the Office or to prevent damage.

The Office uses artificial intelligence tools as an auxiliary means in the framework of providing its services, in full compliance with the provisions of the Privacy Protection Law, 1981 and its amendments, including Amendment 13.

For this purpose, translations and processing of documents containing personal data and sensitive personal data are performed through a commercial account of the type Claude for Work (Team) of Anthropic PBC, in the framework of which the Office is the data Controller, and Anthropic serves as a data Processor only, does not use the data for model training or for any purposes other than for the benefit of the Office, and the data is protected subject to a detailed Data Processing Addendum (DPA). The Office may use other artificial intelligence tools without inputting identifying or personal details, or in anonymous mode only.

The use of artificial intelligence tools does not replace the professional judgment of the Office.

10. Group Messages from the Office / Direct Mailing

The Office may send its clients marketing or advertising information by email, only if you have given explicit consent thereto or if the law permits it. In any case, you may revoke your consent by instruction in a return email or through the unsubscribe link in the body of the message.

11. Your Rights

You have the following rights, subject to the provisions of the Privacy Protection Law, and the legal provisions regarding advocates and notaries:

• Right of access: To review the information as it is stored about you in the Office's databases – translation to another language shall involve payment.
• Right of correction: To request correction of erroneous or inaccurate information.
